RESEARCH

Identification of the issue; and the exploration of the legal principle governing the issue are the crucial steps in a legal research process. Usually, the issues are incorrectly identified, or some issues are missed altogether. Further, the legal doctrines are in a ‘fluid’ state as revealed by the decisions of the Supreme Court: in many areas, one is either confronted with conflicting decisions, or disappointed by the absence of binding authority. In such situations, one has to research the law of other jurisdictions, and apply creative analysis to the existing law or evolve an argument based on first principles. The research task has thus become harder. To make it easier, a new strategy has to be developed; and a good methodology has to be followed. ALERT team, dedicated to providing information that guides researchers to essential sources, makes you more familiar to such strategy and methodology.
